The law on crimes in Florida can all be found in the Florida Statutes. There are federal crimes, which are governed by the United States Code and prosecuted by U.S. Attorneys and the Department of Justice. However, State crimes in Florida are far more common and those are prosecuted by State Attorneys and the Florida Attorney General.
Most of the time, the prosecuting authority will be your local State Attorney. In Orlando and Kissimmee, it is the Office of the State Attorney for the Ninth Judicial Circuit. Chances are that an Assistant State Attorney from that office will be assigned to prosecute your case. Every so often, the Florida Attorney General will pick up a case, which will be prosecuted by a Statewide Prosecutor. But the overwhelming majority are handled by the individual circuit’s elected State Attorney.
